BMSA Footing Solutions

These Terms of Service (“Terms”) govern the use of the BMSA Footing Solutions website and the supply of products and services by BMSA Footing Solutions (“BMSA”, “we”, “us”, “our”). By accessing our website, requesting a quotation, or purchasing our products or services, you agree to be bound by these Terms.

1. Scope of Services

BMSA Footing Solutions provides engineered footing systems, including the RapidStump system, along with associated design, supply, and technical documentation services. Products and services may be custom-designed to suit specific site conditions and structural requirements.

2. Quotations and Orders

  • All quotations are valid for the period stated in the quotation unless otherwise specified.

  • Quotations are based on information provided by the customer, including soil reports, structural drawings, and site details.

  • Orders are confirmed once accepted in writing and may be subject to a deposit or full payment prior to commencement.

3. Design Responsibility

  • Designs provided by BMSA are based on the information supplied by the customer and/or their consultants.

  • BMSA is not responsible for errors resulting from incomplete, inaccurate, or outdated information.

  • Any changes to site conditions, soil classification, or structural loads after design approval may require redesign and additional costs.

4. Custom-Designed Products

Many BMSA products are custom-designed and manufactured for individual projects. Once design approval or manufacturing has commenced:

  • Orders cannot be cancelled without written consent from BMSA.

  • Refunds are not available for change-of-mind cancellations.

5. Pricing and Payment

  • Prices are exclusive of GST unless stated otherwise.

  • Payment terms are as stated on the invoice or quotation.

  • Late payments may result in delays, suspension of supply, or additional charges.

6. Delivery and Risk

  • Delivery dates are estimates only and may be affected by factors outside BMSA’s control.

  • Risk in goods passes to the customer upon delivery to the nominated location.

  • The customer is responsible for inspecting products upon delivery and notifying BMSA of any issues before installation.

7. Installation and Use

  • Products must be installed strictly in accordance with BMSA documentation and applicable standards.

  • BMSA is not responsible for failures or defects caused by incorrect installation, misuse, or unauthorised modification.

  • Installation remains the responsibility of the builder, contractor, or installer.

8. Warranties and Limitations

  • BMSA warrants that products will be supplied in accordance with the approved design and specifications.

  • To the maximum extent permitted by law, BMSA excludes liability for indirect, consequential, or economic loss.

  • Nothing in these Terms excludes rights provided under applicable consumer protection legislation.

9. Intellectual Property

All designs, drawings, documentation, and content provided by BMSA remain the intellectual property of BMSA unless otherwise agreed in writing. These materials may not be reproduced or used for other projects without consent.

10. Website Use

  • Website content is provided for general information only and does not constitute engineering advice.

  • BMSA reserves the right to update or modify website content at any time without notice.

11. Termination

BMSA reserves the right to refuse service or terminate agreements where payment terms are not met or where misuse of products or documentation occurs.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which BMSA Footing Solutions operates. Any disputes shall be subject to the exclusive jurisdiction of the relevant courts.
